Terms of Sale and Website Use

1. Seller and scope

These terms govern product orders and use of our store. SneakerMood is your seller, including where we source a product through a supplier; Shopify provides the ecommerce technology. We are an independent reseller unless a specific authorised relationship is expressly stated. Third-party trademarks identify the products and do not by themselves imply affiliation.

A consumer is a natural person acting for purposes outside their trade, business or profession; the applicable mandatory rules determine the treatment of mixed-purpose purchases. Mandatory consumer rights prevail over any conflicting provision. The Returns and Refunds Policy and Shipping Policy form part of the sale terms made available before the order. Our Privacy Policy explains data processing; agreeing to a purchase does not constitute marketing or tracking consent.

2. Ordering and contract formation

Select the product, variant, size and quantity, add it to your cart, then enter contact, delivery and payment details. Before submitting, you can review and correct entries, remove items and see the total price. The payment button indicates that the order involves an obligation to pay. Orders require legal capacity; minors must have the necessary parent or guardian authorisation under the applicable law.

Your order is an offer to buy. We acknowledge receipt electronically without undue delay and no later than 48 hours. If the acknowledgement does not arrive within that period, you are released from the offer or contractual obligation as provided by Hungarian ecommerce law. An acknowledgement labelled as receipt only does not itself accept the order. We accept by an express acceptance email or dispatch confirmation, whichever comes first, and normally decide within two business days. If we cannot accept within that time, we seek your agreement to any extension; you are not bound indefinitely. Payment authorisation alone is not acceptance. The wording of an actual confirmation that expressly accepts an order takes precedence over a general description of the process.

Before acceptance we may reject an order for a legitimate reason, such as unavailability, an obvious pricing error, an unsupported destination, failed payment or substantiated fraud concerns. We explain the issue where lawful and promptly release or refund any amount taken. After acceptance, we do not reserve an unrestricted right to cancel, alter the price or substitute a different product; applicable contract remedies govern.

Contracts may be concluded in Dutch, English, German, Hungarian or French, as selected and supported at checkout. The version supplied in the contract language applies; another translation cannot reduce mandatory rights. We provide the order details and applicable sale and withdrawal terms in a form you can retain. Electronic order records can be requested from customer service after proportionate identification. Where French mandatory electronic-contract retention rules apply to an order of €120 or more, we retain the contract for the required ten-year period and provide access on request. We are not subject to a voluntarily adopted industry code unless we expressly identify one.

Adding goods to a cart does not reserve stock. Availability is checked before acceptance, including for goods obtained through suppliers. Quantity limits or purchase restrictions apply only if disclosed before the order. If we cannot supply the selected goods, we will not substitute a different size, colour or model without your agreement.

You must give accurate order and contact details and correct an error promptly. Before accepting a transaction, we may request proportionate information needed to verify an apparent address, payment or fraud discrepancy. We do not request complete card credentials or unrelated identity information. If a material discrepancy cannot be resolved, we may decline the unaccepted order and release or refund the payment. Our statutory delivery, cancellation and refund duties continue to apply.

Supplier network and order changes. The process described in section 9 of our Returns and Refunds Policy forms part of the total delivery estimate. A change to the size, model, quantity or delivery address after ordering requires our express agreement and may no longer be possible once processing begins. A request to change an order does not itself change the contract or limit an available statutory right of withdrawal.

Orders placed separately are processed separately and cannot be combined afterwards at the customer's request. Each order has its own delivery charge and free-shipping threshold. Place the items in one order if you want them processed together; we may still split delivery as explained in the Shipping Policy. Separate orders cannot be added together retrospectively to qualify for free shipping. Statutory withdrawal rights remain available.

The standard checkout creates an electronic contract, not a separately signed written contract. We record the order and its acceptance electronically and retain the applicable terms; you may request access to your order records at info@sneakermood.eu. A purchase is a one-off sale, not an automatically renewing subscription.

3. Products, prices and payment

SneakerMood works with an extensive network of verified European suppliers and independent resellers. Our selection includes goods held by us and goods available through this network. For goods supplied through our partners, arrival at our premises is followed by authenticity, condition and order-completeness checks before dispatch to you. The stated 2–14 business day delivery estimate includes supplier coordination, arrival, verification, preparation and delivery. An item available through our network is not necessarily ready for immediate dispatch from our own premises. SneakerMood remains your seller and is responsible for the agreed delivery and statutory remedies.

Products are sourced from suppliers and independent resellers. The physical condition of each product, including whether it is new and unworn or pre-owned, is the condition stated in its product description. A product described as new and unworn is supplied in that condition; resale or the tax treatment does not itself mean that the product has been worn. We remain the contracting seller.

Most of our sales use the VAT margin scheme where its legal conditions are met. VAT is then not separately itemised and the buyer cannot deduct a separately stated VAT amount. Other transactions use the tax treatment legally applicable to them; a zero rate or exemption is applied only where its conditions are satisfied. The invoice contains the required scheme indication. Providing an EU VAT number does not by itself convert a margin-scheme purchase into a VAT-free purchase or reduce the agreed consumer price.

Depending on the payment method selected, online payments are processed through Shopify Payments or, for Klarna, through Mollie. Available options may include payment cards, digital wallets, local payment methods, iDEAL | Wero and Klarna. The methods available for your order, payment timing and applicable conditions are displayed at checkout before you place the order. Availability depends on the destination, currency and provider eligibility; Klarna may require a provider assessment. Cash on delivery is offered for Hungary on the terms and charges in the Shipping Policy.

If you choose a pay-later service, the payment provider's terms govern that payment arrangement; we remain responsible for the goods and your statutory rights against us. A failed application does not authorise us to debit another payment method without your agreement. Where payment is validly due and remains unpaid, we may require payment and exercise lawful remedies after any required notice or additional period. Only legally recoverable interest and collection costs may be claimed.

The product page specifies the principal characteristics, selected size, condition and any known material departure from the usual condition. Goods described as new are sold as new. Any second-hand condition, damaged packaging or other material variation must be clearly disclosed; a departure from objective conformity requirements requires separate express acceptance where the law requires it. A generic statement about manufacturing variation cannot excuse non-conformity. Screen colours and sizing guidance do not override the product description or statutory standards.

Our selling prices may differ from recommended retail prices. The applicable currency, tax treatment, delivery charge and total payable are displayed before payment. EU consumer prices include applicable taxes. If a lawful VAT margin scheme applies, the invoice reflects that scheme and does not separately show deductible VAT. A crossed-out price or advertised reduction is presented in accordance with the applicable reference-price rules. A completed purchase is not repriced merely because the market changes later.

We correct obvious errors promptly. An unusually low price is not automatically an error; the circumstances must make the mistake reasonably recognisable. We do not charge a higher corrected price without your agreement. Payment methods, payment timing and any provider conditions are displayed at checkout. Use a method you are authorised to use. For consumers protected by Dutch advance-payment rules, we provide an option that does not require advance payment of more than half the purchase price; full prepayment may be freely chosen. A separate pay-later provider's lawful conditions do not remove your rights against us.

Promotional codes are subject to the eligibility, value, expiry and combination rules shown before use. A free promotional code is not cash and cannot be exchanged for money. Paid gift cards and legally due refunds are governed by their own rights, not a promotional code's expiry. Proven code manipulation may justify correction of the affected benefit or refusal of a future offer, subject to existing contractual and consumer rights. Exercising legitimate return or complaint rights is not misuse.

Enter a valid discount code before placing the order. We do not add codes or grant voluntary price adjustments retrospectively. Codes cannot be combined with other codes, promotions or bundle discounts unless the specific offer expressly allows it. An expressly offered bundle or permitted combination remains available on its stated terms. This does not prevent correction if we failed to apply the price or discount actually agreed for your order.

4. Delivery and ownership

Estimated standard delivery is 2–14 business days, including processing, counted from receipt of the order and any payment required under the chosen method, unless a different product-specific delivery period is clearly agreed before purchase. A business day is Monday to Friday excluding relevant public holidays. The full country rates and the €180 EU free standard shipping threshold appear in the Shipping Policy and checkout.

Delay does not remove our delivery duties. If an agreed period is missed, the consumer may set an appropriate additional period and terminate if we still fail to deliver. No additional period is needed where the law permits immediate termination, including our refusal to deliver or a delivery date that was expressly essential. If no delivery time was agreed, the statutory default normally requires delivery without undue delay and within 30 days. We refund sums due without undue delay following valid termination.

Risk normally passes when you or your designated person other than the carrier takes physical possession. Where you independently commission a carrier that we did not offer, the statutory exception may apply. We remain your contact for goods lost or damaged with our delivery carrier. Title remains with us until full payment to the extent permitted by applicable law; this does not change mandatory risk rules.

For delivery outside the EU or its relevant customs/tax territory, the import charges and responsibilities disclosed before the purchase apply. We do not shift charges arising from our error or our mandatory delivery responsibilities to you. Incorrect address, unjustified non-collection or repeat delivery may result only in reasonable, actual, documented and legally recoverable additional costs, explained before a paid redelivery is arranged. There is no automatic forfeiture of the product price or double recovery of the same transport cost.

For an uncollected parcel, the notice, seven-day contact period, redelivery and substantiated cost rules in section 11 of the Returns and Refunds Policy apply. Any termination by us must meet the applicable legal conditions; non-collection is not treated as automatic forfeiture or as a consumer's withdrawal notice.

5. Withdrawal and refunds

Consumers have the withdrawal rights, model form, return instructions and refund timetable in the Returns and Refunds Policy supplied with these terms. In brief: notify within 14 calendar days from receipt, then dispatch within 14 days of notification. An optional EU return label costs €14.95 per used parcel label for change-of-mind returns. Independent return shipping is permitted. Faulty-product remedies are separate. The right cannot be made dependent on our discretionary approval, a mandatory unboxing video or an undamaged ordinary seal.

6. Legal conformity rights

We are responsible for delivering goods that meet the contract and applicable legal conformity standards. For consumer goods, EU rules generally provide seller liability for defects existing at delivery and becoming apparent within at least two years, subject to stronger national rules, limitation provisions and legal extensions. For consumers protected by Dutch law there is no general fixed two-year maximum: reasonable expected durability depends on the goods and circumstances, including their description, price and normal use. The right of withdrawal and an optional manufacturer's commercial guarantee do not replace these rights.

Normally you may choose a free repair or replacement unless the chosen remedy is impossible or disproportionate under the applicable law. Remedial work must occur within a reasonable time and without significant inconvenience. A price reduction or termination and refund is available in the circumstances prescribed by law, including failed or refused remedies or a sufficiently serious defect; termination may be excluded for a merely minor defect. Mandatory rules on burden of proof, notification and remedies prevail. You can contact us directly and are not required to pursue the manufacturer first.

For purchases governed by the Hungarian consumer rules, the general period for asserting conformity claims is two years from performance. A defect discovered within the first year is presumed to have existed at delivery unless incompatible with the nature of the goods or defect. Report a discovered defect without delay; a report within two months of discovery is treated as timely. Before a remedy we explain the repair/replacement choice and, where section 13(4) of Government Decree 373/2021 applies, the one-time 12-month extension of the limitation period following repair. Applicable suspension and restart rules remain intact.

Hungarian product-warranty rights may also allow a consumer to seek repair or replacement from the manufacturer or qualifying distributor within two years after the product was placed on the market, subject to the statutory conditions. The same loss cannot be recovered twice. An additional mandatory guarantee under Government Decree 151/2003 applies only to goods and transactions within its statutory scope; ordinary footwear or clothing does not automatically carry that additional guarantee. Any voluntary guarantee actually offered is described separately and does not reduce legal rights.

Normal wear consistent with expected durability, damage caused by misuse and failure to follow appropriate care instructions do not by themselves establish an original defect. We assess the circumstances and applicable evidential rules; this clause does not exclude premature failure or a defect concealed at delivery. A repair by another person does not automatically cancel unrelated statutory rights. For safety defects or product recalls, mandatory remedies and cost responsibilities remain unaffected.

Additional mandatory French guarantees are set out in the French consumer annex accompanying these terms wherever French mandatory consumer law applies, regardless of the language used to order.

7. Complaints and dispute resolution

Send complaints to info@sneakermood.eu, our telephone contact or our correspondence address above. Describe the order, issue and remedy sought; evidence helps but we do not require an original receipt if the purchase can otherwise be established. We examine oral complaints promptly. If unresolved or disputed, we record them and provide the required record. Written complaints receive a reasoned substantive reply within 30 days, unless a shorter or different mandatory deadline applies. This does not extend delivery, withdrawal-refund or defect-remedy deadlines. A rejection includes the relevant authority or dispute-resolution information required by law.

You may apply to the competent Hungarian conciliation body. The body at our registered office is the Budapesti Békéltető Testület, 1016 Budapest, Krisztina krt. 99., Hungary; correspondence: 1253 Budapest, Pf. 10.; telephone: +36 1 488 2131; email: bekelteto.testulet@bkik.hu; bekeltet.bkik.hu. Competence may also depend on your residence and the type of dispute. We comply with our statutory cooperation obligations; we do not exclude participation or binding decisions where required by law. Consumer authorities can address regulatory infringements; contractual monetary claims may require conciliation or a court.

For cross-border help, contact the European Consumer Centre in your country via ECC-Net. ADR information is also available through the European Commission's consumer redress portal. These services are not a promise that a particular body has jurisdiction over every dispute. The discontinued EU ODR platform is not used for new complaints. Court remedies remain available.

8. Website use and responsibility

Keep account access codes and any credentials confidential, use an email account you control and tell us promptly about suspected unauthorised access. You are responsible for actions you actually authorise, subject to mandatory law; you are not automatically liable for every unauthorised act involving your account. We may restrict compromised access or suspend a function where proportionate to a genuine security threat or substantiated misuse. This does not extinguish existing orders, refund claims or statutory rights.

False orders, payment fraud, counterfeit or substituted returns, manipulation of promotions, interference with security and access to non-public systems without authorisation are prohibited. We may decline unaccepted transactions, restrict future access where justified, preserve necessary evidence and pursue actual recoverable loss or report suspected unlawful conduct through appropriate channels. Lawful withdrawal, complaints, truthful reviews and payment disputes are not, by themselves, misuse.

Our website content and branding are protected to the extent provided by intellectual property law. Commercial copying, unauthorised extraction of protected databases and automated access that circumvents safeguards require permission unless permitted by law. You may retain the policies and order records for personal use and exercise statutory exceptions. Third-party content and links do not amend our contractual obligations or make us responsible for that third party's separate service beyond what the law requires.

Website access may be interrupted for maintenance, technical faults or events beyond our reasonable control. We take reasonable steps to restore access; an interruption does not eliminate accepted orders or payment obligations owed by us. Customer support remains available at the stated contact details.

Liability is determined under applicable law. No provision excludes or restricts liability that cannot lawfully be excluded, including applicable liability for intentional conduct, gross negligence, death, personal injury or defective products. Events beyond reasonable control are assessed under that law and do not grant an indefinite extension of delivery or remove a legally required refund. Recoverable losses and available remedies are governed by the applicable legal rules.

9. Applicable law and changes

Hungarian law governs these terms. This choice does not deprive a consumer of the protection of mandatory provisions of the law of their habitual residence where Article 6 of the Rome I Regulation applies. Jurisdiction follows the applicable rules, including the consumer protections of the Brussels I bis Regulation. No clause requires an eligible Dutch, German, French or other consumer to sue exclusively in Hungary.

The terms presented and accepted for your order remain applicable to that order. Later revisions apply prospectively unless a lawful, expressly agreed change says otherwise. An invalid provision does not invalidate the remaining terms where they can continue under the law; it is replaced by the applicable legal rule, not automatically by the most seller-favourable wording. Individual express agreements and mandatory law prevail over conflicting standard text.

Garantie légale de conformité

Vous bénéficiez de la garantie légale de conformité pour les défauts existant lors de la délivrance et apparaissant dans les deux ans suivant celle-ci, selon les articles L. 217-3 et suivants du Code de la consommation. Pour un bien neuf, pendant ces deux ans, vous devez établir le défaut mais n'avez pas à prouver qu'il existait dès la livraison : la présomption légale s'applique, sauf preuve contraire admise par la loi. Pour un bien expressément vendu d'occasion, cette présomption dure douze mois ; la responsabilité pour les défauts concernés reste de deux ans. Les suspensions, prolongations et règles de prescription applicables restent préservées.

Vous pouvez demander la réparation ou le remplacement, dans les limites légales d'impossibilité et de disproportion. La mise en conformité doit être gratuite, sans inconvénient majeur et achevée au plus tard trente jours après votre demande. Le vendeur expose sur support durable le motif d'un refus légalement justifié. Vous pouvez suspendre le paiement de tout ou partie du solde dans les conditions prévues par la loi.

Pour les contrats auxquels les règles françaises entrées en vigueur le 31 juillet 2026 s'appliquent, une réparation au titre de cette garantie ouvre droit à la prolongation légale de douze mois. Lorsque vous demandez une réparation mais que le vendeur impose le remplacement, le bien de remplacement bénéficie d'un nouveau délai de garantie de deux ans à compter de sa délivrance. La durée d'immobilisation nécessaire à la remise en conformité suspend le délai restant dans les conditions légales.

Vous pouvez obtenir une réduction du prix en conservant le bien, ou résoudre le contrat et être remboursé contre restitution, dans les cas prévus par la loi : refus de mise en conformité, dépassement du délai légal, inconvénient majeur ou frais laissés définitivement à votre charge, ou persistance du défaut malgré une tentative de mise en conformité. La gravité du défaut peut justifier directement ces recours sans réparation ni remplacement préalables. La résolution n'est pas ouverte pour un défaut mineur ; il appartient au vendeur d'en établir le caractère mineur lorsque la loi le prévoit. Les frais et remboursements suivent les délais impératifs du Code de la consommation, sans imposer un avoir ou de frais de retour au consommateur.

La mise en œuvre de la garantie pendant le délai de rétractation interrompt ce délai dans les conditions françaises applicables ; un nouveau décompte intervient à la délivrance du bien conforme réparé ou remplacé. Une garantie commerciale éventuellement accordée ne remplace pas la garantie légale.

Garantie légale des vices cachés

Vous bénéficiez également de la garantie des articles 1641 à 1649 du Code civil pour un vice caché, antérieur à la vente et suffisamment grave pour rendre le bien impropre à l'usage prévu ou diminuer cet usage au point que vous ne l'auriez pas acheté, ou auriez payé moins, en le connaissant. Vous devez établir que ces conditions sont réunies. L'action s'exerce dans les deux ans suivant la découverte du vice, sous réserve du délai butoir et des règles légales applicables. Vous pouvez choisir de rendre le bien et récupérer le prix ou le conserver et obtenir une réduction du prix, conformément à l'article 1644. Les autres droits, notamment à réparation du préjudice lorsque les conditions légales sont réunies, demeurent applicables.
